Onur Dedeoglu was booked to drive three school friends home in August 2018, but after two boys got out in Bondi, he turned off his driver app, parked and climbed into the back seat.

The victim woke to the driver 20 years her senior kissing her and with his hand down her trousers.

Dedeoglu was found guilty at trial of sexual intercourse without consent and two counts of assault with an act of indecency but has not shown any remorse, NSW District Court Judge Nicole Noman said on Tuesday.

The 39-year-old's continued argument that the girl in effect propositioned him "speaks to him having no insight", she said.

"(The victim) was asleep and unable to protect herself," the judge said on Tuesday.

"She placed herself in a position of trust (and Dedeoglu) took advantage of the situation."

Uber records show Dedeoglu arrived outside the girl's North Bondi home about 1.32am and turned off his app.

The app was switched back on about 1.50am at a nearby beach car park, moments after the girl had fled the car.

His DNA was found on the girl's bra cups, near her trousers' zipper and on her underwear.

Judge Noman was satisfied Dedeoglu switched his app off to shield his movements during the opportunistic attack.

But exactly how long the acts went on remained unclear, she said, as the driver's account was "highly improbable" and the girl could only recall the last moments when she came to.

Dedeoglu claimed he thought the girl was aged in her mid-20s, but the judge said CCTV of her and her friends showed they "looked their age".

The trio had been celebrating the end of trial Year 12 exams and the 18th birthdays of friends.

The victim had stopped drinking hours before the attack and told the trial she felt tiredness was primarily why she fell asleep in the back seat.

The rape had left her feeling violated, distraught and with overwhelming anger, she later told the court.

She was saddened that "at the age of 17, I had to see the world in a different lens and question men's intentions more than I should have to", the court heard.

Judge Noman said it was common for rideshare passengers to be intoxicated or tired and that often served as motivation to use such services.

The victim would undoubtedly carry trauma and long-term psychological effects may manifest at a later stage, she said.

"The harm is almost inevitable," she said.

Dedeoglu will likely be deported to Turkey once his six-year non-parole period ends.

His sentence - backdated to April 2, 2019 - accounts for time served in immigration detention and prison, his prior good character and the limited access he has to his immediate family, now living in Turkey.

The onerous effects of coronavirus restrictions on prisoners also reduced his term to a modest extent, the judge said.
