A man and woman from Queensland who were also in the car were charged after the car crashed near Nerong on Tuesday, December 4.
A child at risk notification was submitted to Family and Community Services after the arrests, police said.
At about 7am, officers attached to Manning Great Lakes Police District saw the allegedly stolen and speeding BMW X1 travelling south on the Pacific Highway at Ghinni Ghinni.
Officers attempted to stop the vehicle and gave chase but after it failed to stop.
The pursuit was terminated near Forster due to safety concerns.
A short time later, the vehicle was again seen speeding south on the Pacific Highway.
The vehicle was monitored as it entered Nerong. It soon crashed into trees off Sandflat fire trail.
Officers attended and established a perimeter.
The passenger, a 25-year-old woman, and two children, aged three and five, were found in Redbill Road.
The driver, a 22 year-old man, was pursued on foot into nearby bushland and with assistance of Polair and the dog unit, he was arrested near Nerong Creek.
The man, woman and children were taken to Forster Police Station.
The man was charged with driving more than 45 kilometres per hour over the speed limit, driving dangerously and not stopping in a police pursuit, two counts of drive recklessly/furiously or speed/manner dangerous, never being licensed and driving on the road, two counts of driving with child not restrained as prescribed, drive conveyance taken without consent of owner and receiving property stolen outside NSW.
He was refused bail to appear at Forster Local Court on Wednesday, December 5.
The woman was charged with being in the stolen car.
She was granted conditional bail to appear at Forster Local Court on Wednesday, December 19.
